Summaries of General Laws Passed at the 2003
Regular Session of the Florida Legislature

Ch. 2003-1 (S.B. 580)  Amends, repeals, transfers, or reenacts various provisions in the Florida Statutes to replace incorrect cross-references, delete obsolete or expired provisions, correct grammatical and typographical errors, remove inconsistencies and redundancies, and otherwise improve the clarity of the statutes. Effective July 1, 2003.

Ch. 2003-2 (S.B. 582)  Repeals numerous provisions of the Florida Statutes which were repealed by other than a “current session” of the Legislature for the purpose of omitting such provisions from publication in the Florida Statutes 2003; amends and reenacts specified provisions to conform. Effective July 1, 2003.

Ch. 2003-3 (S.B. 584)  Removes gender-specific references to human beings from the Florida Statutes without substantive change in legal effect. Effective July 1, 2003.

Ch. 2003-4 (S.B. 586)  Repeals certain superseded provisions relating to apportionment of State Senate and House of Representative districts. Effective July 1, 2003.

Ch. 2003-5 (S.B. 588)  Amends provisions of the Florida Statutes to replace incorrect cross-references, delete obsolete or expired provisions, correct grammatical and typographical errors, remove inconsistencies and redundancies, and otherwise improve the clarity of the statutes. Effective July 1, 2003.

Ch. 2003-6 (S.B. 1488)  Creates and revises provisions to conform to the reorganization of the Cabinet. Effective April 1, 2003.

Ch. 2003-7 (H.B. 803)  Designates January of each year as “Florida Jewish History Month.” Effective April 17, 2003.

Ch. 2003-8 (H.B. 1739)  Creates and revises provisions relating to access to postsecondary education and students with disabilities. Effective April 24, 2003.

Ch. 2003-9 (C.S. for S.B. 2322)  Extends the medically needy program coverage to July 1, 2003; provides for program funding. Effective May 1, 2003.

Ch. 2003-10 (C.S. for S.B. 160)  Creates an exception to controlled substance scheduling for certain industrial uses of specified chemicals; clarifies hours during which it is unlawful to commit certain offenses near a school or other specified facility; corrects a case citation relating to trafficking offenses. Effective May 2, 2003.

Ch. 2003-11 (H.B. 1099)  Revises procedures for certification and funding of domestic violence centers. Effective January 1, 2004.

Ch. 2003-12 (C.S. for S.B. 626)  Revises, reenacts, and repeals provisions relating to Everglades restoration. Effective May 20, 2003.

Ch. 2003-13 (C.S. for S.B. 192)  Authorizes release of specified library circulation record information of persons under 16 years of age for the purpose of collecting fines or recovering overdue materials. Effective July 1, 2003.

Ch. 2003-14 (C.S. for C.S. for C.S. for S.B. 592)  Creates and revises provisions relating to nonprofit corporations, electronic transmission, condominiums, residential cooperatives, and homeowners’ associations. Effective May 21, 2003.

Ch. 2003-15 (S.B. 1080)  Provides that theft of anhydrous ammonia is grand theft and a felony of the third degree; adds anhydrous ammonia to list of precursor chemicals that may not be unlawfully possessed or distributed because they may be used in manufacture of controlled substances. Effective July 1, 2003.

Ch. 2003-16 (C.S. for S.B. 1182)  Revises a public records exemption for certain security system plans. Effective May 21, 2003.

Ch. 2003-17 (S.B. 1430)  Exempts certain sales of manufactured gas from the gross receipts tax and the municipal public service tax. Effective May 21, 2003.

Ch. 2003-18 (S.B. 1648)  Revises requirements for collection and handling of specimens for the DNA data bank from certain criminal offenders. Effective July 1, 2003.

Ch. 2003-19 (S.B. 2164)  Creates and revises provisions relating to enterprise zone boundary amendments and a specified designation. Effective May 21, 2003.

Ch. 2003-20 (C.S. for C.S. for S.B. 2520)  Revises certain licensing provisions of the Beverage Law. Effective July 1, 2003.

Ch. 2003-21 (S.B. 2680)  Creates and revises provisions relating to unclaimed property, including demutualization proceeds, equity and debt of business associations, and certain firearms and ammunition. Effective May 21, 2003.

Ch. 2003-22 (H.B. 267)  Authorizes electronic sales of tax certificates for unpaid taxes; provides an exception for certain homestead property. Effective May 21, 2003.

Ch. 2003-23 (H.B. 479)  Defines the offense of cyberstalking and provides penalties; reenacts specified provisions. Effective October 1, 2003.

Ch. 2003-24 (H.B. 953)  Prohibits provision of nonprescription weight-loss pills to persons under 18 years of age; provides penalties; specifies a defense; defines the term “weight-loss pill.” Effective July 1, 2004.

Ch. 2003-25 (H.B. 1017)  Designates portions of the Florida Statutes 2003 which constitute the official statute law of the state. Designates general laws which are, and which are not, repealed by the adoption of the Florida Statutes 2003. Effective July 1, 2003.

Ch. 2003-26 (H.B. 1155)  Renames the Challenger license plate as the Challenger/Columbia license plate. Effective July 1, 2003.

Ch. 2003-27 (H.B. 1553)  Requires prisoners who desire to file complaints with the Department of Health against health care providers employed by the Department of Corrections to first exhaust all available administrative remedies within the Department of Corrections; provides an exception when the practitioner may present a danger to nonprisoners. Effective May 21, 2003.

Ch. 2003-28 (C.S. for S.B. 260)  Permits condominium unit owners to display portable, official armed services flags on designated holidays. Effective July 1, 2003.

Ch. 2003-29 (S.B. 312)  Requires the Department of Juvenile Justice to adopt rule procedures to provide notice of policy changes affecting contracted delinquency services and programs. Effective July 1, 2003.

Ch. 2003-30 (S.B. 482)  Eliminates liquidated damages liability for early termination of a lease by a member of the United States Armed Forces; prohibits discrimination against such member in offers for rent or rental terms; prescribes conditions for termination of a tenancy with specific duration. Effective May 23, 2003.

Ch. 2003-31 (S.B. 634)  Extends the Big Bend Historic Saltwater Paddling Trail from the Suwannee River to Yankeetown. Effective May 23, 2003.

Ch. 2003-32 (C.S. for S.B. 654)  Creates and revises provisions relating to the regulation of telecommunications companies. Effective May 23, 2003.

Ch. 2003-33 (C.S. for S.B. 1126)  Revises the distribution formula for proceeds from the local government half-cent sales tax. Effective May 23, 2003, and retroactively applicable to October 1, 2000.

Ch. 2003-34 (S.B. 1162)  Reenacts and revises provisions relating to the tourist development tax. Effective May 23, 2003.

Ch. 2003-35 (C.S. for S.B. 1232)  Revises provisions relating to the practice of pest control concerning vehicle and employee identification, certification, discipline, and penalties for violation. Effective July 1, 2003.

Ch. 2003-36 (C.S. for C.S. for S.B. 1448)  Creates, revises, and repeals provisions relating to unemployment compensation. Effective October 1, 2003, except as otherwise provided.

Ch. 2003-37 (C.S. for S.B. 1566)  Limits the use of certain tourist development tax revenues for purposes other than those originally designated. Effective July 1, 2003.

Ch. 2003-38 (C.S. for S.B. 1582)  Defines the term “blood establishment” as it relates to blood donations; provides standards for operation of such establishments and authorizes injunctive action against violators. Effective July 1, 2003.

Ch. 2003-39 (S.B. 1862)  Permits community development districts to collect ground rent from owners of long-term ground leases with governmental entities; authorizes contracts for such collection. Effective July 1, 2003.

Ch. 2003-40 (C.S. for S.B. 1896)  Provides for alternatives to posting the times during which restrictive school speed zones will be enforced. Effective May 23, 2003.

Ch. 2003-41 (C.S. for S.B. 2084)  Requires written drug prescriptions to be legibly printed or typed; mandates that certain information be included on such prescriptions. Effective July 1, 2003.

Ch. 2003-42 (C.S. for S.B. 2378)  Revises provisions relating to veterans. Effective May 23, 2003.

Ch. 2003-43 (S.B. 2450)  Revises certain provisions of the Florida Uniform Principal and Income Act. Effective May 23, 2003, and retroactively operative to January 1, 2003.

Ch. 2003-44 (S.B. 2802)  Requires the Department of Education to assist the transition of dependents of military personnel into the public school system. Effective May 23, 2003.

Ch. 2003-45 (S.B. 88)  Permits certain low-emission vehicles to be driven in high occupancy vehicle (HOV) lanes regardless of vehicle occupancy; defines the term “hybrid vehicle”; provides for decals and registration certificates. Effective July 1, 2003.

Ch. 2003-46 (S.B. 530)  Prohibits modification of a legally binding organ donation after the organ donor’s death; revises provisions regarding amendment or revocation of an anatomical gift. Effective July 1, 2003.

Ch. 2003-47 (C.S. for S.B. 680)  Authorizes a bachelor of science in human performance degree program with a concentration in athletic training at Florida Gulf Coast University. Effective May 27, 2003.

Ch. 2003-48 (C.S. for C.S. for S.B. 1220)   Requires certain disclosures to prospective parcel owners in a community. Effective July 1, 2003.

Ch. 2003-49 (C.S. for C.S. for S.B. 1286)  Requires the use of alternative dispute resolution mechanisms prior to filing a lawsuit in certain construction defect matters; defines specified terms; prescribes resolution conditions and procedures. Effective May 27, 2003.

Ch. 2003-50 (C.S. for C.S. for S.B. 1480)  Provides a felony penalty for breaking or damaging a fence if animals are contained by the fence at the time of the offense. Effective July 1, 2003.

Ch. 2003-51 (C.S. for S.B. 1992)  Authorizes the award of a Medal of Heroism to specified recipients who distinguish themselves in the line of duty and under certain circumstances. Effective July 1, 2003.

Ch. 2003-52 (S.B. 2082)  Requires that certain health practitioners notify the mother of a deceased fetus of her options as to disposition of the fetal remains; provides for notification and election forms. Effective May 27, 2003.

Ch. 2003-53 (H.B. 439)  Creates the Statewide Guardian Ad Litem Office; provides for transfer of funds and positions to the office. Effective July 1, 2003.

Ch. 2003-54 (H.B. 947)  Revises provisions relating to tests for the presence of alcohol, chemicals, or controlled substances in motorists. Effective May 27, 2003.

Ch. 2003-55 (H.B. 1609)  Revises requirements for information to be contained in budget requests furnished to the Legislature by executive agencies and the judicial branch. Effective July 1, 2003.

Ch. 2003-56 (C.S. for S.B. 2526)  Creates a public records exemption for certain information contained in the Florida Putative Father Registry. Effective May 30, 2003.

Ch. 2003-57 (C.S. for S.B. 2568)  Creates and revises provisions relating to the protection and delivery of services to disabled, vulnerable, or elderly persons; revives a provision relating to background screening of specified persons affiliated with health care services pools. Effective May 30, 2003.

Ch. 2003-58 (H.B. 835)  Creates, revises, and repeals provisions relating to adoption. Effective May 30, 2003.

Ch. 2003-59 (S.B. 174)  Revises provisions relating to the protection of marine turtles. Effective July 1, 2003.

Ch. 2003-60 (S.B. 258)  Authorizes local governments to pay certain expenses by electronic funds transfer. Effective July 1, 2003.

Ch. 2003-61 (C.S. for S.B. 320)  Requires the Agency for Health Care Administration to publish on a website the average wholesale prices for the 200 drugs most frequently dispensed to the elderly; mandates provision of additional information to aid consumers in calculating retail prices. Effective July 1, 2003.

Ch. 2003-62 (C.S. for S.B. 472)  Creates and revises provisions relating to construction materials mining. Effective June 2, 2003.

Ch. 2003-63 (S.B. 488)  Clarifies the distance that certain offenders’ residences must be from a school, day care center, park, playground, or other place where children congregate. Effective June 2, 2003.

Ch. 2003-64 (C.S. for C.S. for S.B. 554)  Redefines the term “interdistrict transfer and use” as it relates to groundwater; validates and continues certain agreements between water management districts. Effective June 2, 2003.

Ch. 2003-65 (C.S. for S.B. 638)  Creates the Access to Better Learning and Education Grant Program; provides for program administration and establishes grant eligibility criteria. Effective June 2, 2003.

Ch. 2003-66 (S.B. 640)  Provides for the issuance of Military Services license plates and annual use fee collection and distribution. Effective July 1, 2003.

Ch. 2003-67 (C.S. for S.B. 642)  Removes the Director of the Office of Long-Term-Care Policy from the office’s advisory council; provides for the council chair’s election and term of office; provides for prepayment or direct vendor payment of travel expenses for certain volunteers; prescribes prioritization guidelines for certain functionally impaired elderly persons; repeals a provision relating to the Office of State Long-Term Care Ombudsman. Effective July 1, 2003, except as otherwise provided.

Ch. 2003-68 (C.S. for S.B. 684)  Creates, revises, and repeals numerous provisions relating to military affairs. Effective June 2, 2003.

Ch. 2003-69 (C.S. for S.B. 738)  Revises requirements for notice of actions to collect worthless checks. Effective July 1, 2003.

Ch. 2003-70 (C.S. for S.B. 1024)  Changes the time for a hearing to adopt a non-ad valorem assessment and prescribes notice for non-ad valorem assessments to be collected for more than 1 year. Effective June 2, 2003.

Ch. 2003-71 (C.S. for C.S. for S.B. 1072)  Creates and revises provisions relating to identity theft and Internet fraud prevention. Effective July 1, 2003.

Ch. 2003-72 (C.S. for S.B. 1098)  Enacts the Florida Uniformed Servicemembers Protection Act; creates, revises, and repeals provisions relating to military affairs. Effective June 2, 2003.

Ch. 2003-73 (C.S. for S.B. 1954)  Provides for the issuance of a U.S. Paratroopers license plate, a Protect Our Reefs license plate, and a Fish Florida license plate and provides for annual use fee collection and distribution. Revises the distribution of annual use fees for Florida Arts license plates. Effective October 1, 2003, except as otherwise provided.

Ch. 2003-74 (C.S. for S.B. 2036)  Revises provisions relating to implied warranties of merchantability and fitness in the procurement, processing, storage, distribution, or use of blood, plasma, blood products, and blood derivatives. Effective June 2, 2003.

Ch. 2003-75 (C.S. for S.B. 2078)  Authorizes provision of temporary certificates for visiting physicians to obtain medical privileges for instructional purposes in conjunction with certain plastic surgery training programs and educational symposiums; provides requirements. Effective June 2, 2003.

Ch. 2003-76 (H.B. 235)  Revises provisions relating to mutual insurance companies. Effective June 2, 2003.

Ch. 2003-77 (H.B. 457)  Reenacts and revises provisions relating to the indigent care and trauma center discretionary sales surtax; requires a biennial audit of a certain trust fund. Effective June 2, 2003.

Ch. 2003-78 (H.B. 533)  Permits county government entities to prohibit business entities that are not county tourism promotion agencies from using specified designations; expands the powers and duties of county tourism promotion agencies. Effective June 2, 2003.

Ch. 2003-79 (H.B. 861)  Prescribes manner and method of preservation of a homeowners’ association claim of right, covenant, or restriction; enumerates powers and duties of certain unit owner controlled associations; prohibits certain amendments to association bylaws. Effective July 1, 2003.

Ch. 2003-80 (H.B. 915)  Revises provisions relating to the K-20 education accountability system; authorizes adoption of equivalent examination scores for high school graduation. Effective June 2, 2003.

Ch. 2003-81 (H.B. 1149)  Creates an entertainment industry financial incentive program; provides purpose; establishes program application and reimbursement procedures; provides penalties for fraudulent claims. Effective July 1, 2003.

Ch. 2003-82 (H.B. 1227)  Clarifies the definition of a self-propelled knife. Effective June 2, 2003.

Ch. 2003-83 (H.B. 1593)  Revises and continues a public records exemption for certain information concerning foster parent applicants and licensed foster parents. Effective June 2, 2003.

Ch. 2003-84 (H.B. 1675)  Prohibits impairing or impeding telephone service or electric power to a dwelling to facilitate a burglary. Effective July 1, 2003.

Ch. 2003-85 (H.B. 1839)  Adopts the 2003 Internal Revenue Code for purposes of the corporate income tax. Effective June 2, 2003, and retroactively operative to January 1, 2003.

Ch. 2003-86 (H.B. 1813)  Allows use of local motor fuel taxes for bicycle paths and pedestrian pathways; authorizing certain municipalities to expend a certain gas tax. Effective June 3, 2003.

Ch. 2003-87 (C.S. for S.B. 54)  Prohibits local governments from requiring employers to pay a minimum wage other than a federal minimum wage; provides exceptions. Effective June 4, 2003.

Ch. 2003-88 (C.S. for C.S. for S.B. 340)  Revises requirements for release of a patient committed for involuntary treatment under the Baker Act. Effective June 4, 2003.

Ch. 2003-89 (C.S. for S.B. 354)  Abolishes the Florida Bright Futures Scholarship Testing Program. Effective July 1, 2003.

Ch. 2003-90 (S.B. 614)  Requires that driving records of nonpublic sector bus drivers be checked by their employers annually; clarifies the application of safety belt requirements for school buses; provides for transportation agreements between public and private schools. Effective July 1, 2003.

Ch. 2003-91 (C.S. for C.S. for S.B. 1006)  Revises provisions relating to state employee health insurance coverage. Effective July 1, 2003.

Ch. 2003-92 (S.B. 1046)  Exempts firefighters from certain motorcycle traffic laws while in the performance of their official duties. Effective June 4, 2003.

Ch. 2003-93 (C.S. for C.S. for S.B. 1334, S.B. 534, and S.B. 360)  Provides for a constitutionally-mandated voluntary universal prekindergarten program. Effective June 4, 2003.

Ch. 2003-94 (C.S. for C.S. for S.B. 1584)  Revises provisions relating to administrative procedures. Effective June 4, 2003.

Ch. 2003-95 (C.S. for S.B. 1588)  Prohibits certain controlled substance offenses within 1,000 feet of universities, public housing facilities, public parks, community centers, or publicly-owned recreational facilities; defines “community center.” Effective July 1, 2003.

Ch. 2003-96 (C.S. for C.S. for S.B. 1616)  Creates and revises provisions relating to seaport security. Effective June 4, 2003.

Ch. 2003-97 (C.S. for S.B. 1754)  Revises provisions relating to soil and water conservation districts and the Soil and Water Conservation Council. Effective July 1, 2003.

Ch. 2003-98 (C.S. for S.B. 1842)  Permits certain municipalities to impose and collect specified surcharges for the sale, lease, or rental of space at parking facilities; prescribes conditions for surcharge collection, use, and administration. Effective June 4, 2003.

Ch. 2003-99 (S.B. 2190)  Requires continuing education for certain public adjusters; provides requirements; provides for implementation and administration. Effective June 4, 2003.

Ch. 2003-100 (H.B. 1021)  Revises and continues a public records exemption for certain information regarding applicants for housing assistance programs. Effective October 1, 2003.

Ch. 2003-101 (H.B. 1023)  Revises and continues a public records exemption for county employee assistance program records. Effective October 1, 2003.

Ch. 2003-102 (H.B. 1025)  Revises and continues a public records exemption for municipal employee assistance program records. Effective October 1, 2003.

Ch. 2003-103 (H.B. 1027)  Continues a public records exemption for certain records containing trade secrets held by the Department of Community Affairs. Effective October 1, 2003.

Ch. 2003-104 (H.B. 1031)  Continues and expands an exemption from public records requirements for certain Florida Kidcare program applicant and enrollee information; prescribes disclosure conditions. Effective June 4, 2003.

Ch. 2003-105 (H.B. 1033)  Revises and continues an exemption from public records and public meeting requirements for certain information identifying a subscriber to a managed health care entity; prescribes conditions. Effective October 1, 2003.

Ch. 2003-106 (H.B. 1035)  Revises and continues an exemption from public records requirements for certain investigatory records relating to workers’ compensation employer compliance; prescribes disclosure conditions. Effective October 1, 2003.

Ch. 2003-107 (H.B. 1039)  Revises and continues an exemption from public records requirements for certain investigatory information held by the Division of Florida Land Sales, Condominiums, and Mobile Homes; prescribes disclosure conditions. Effective October 1, 2003.

Ch. 2003-108 (H.B. 1041)  Revises and continues exemptions from public records and public meetings requirements for the Florida Automobile Joint Underwriting Association. Effective October 1, 2003.

Ch. 2003-109 (H.B. 1591)  Revises and continues an exemption from public records laws for state employee assistance program records. Effective October 1, 2003.

Ch. 2003-110 (H.B. 1785)  Creates a public records exemption for personal identifying information contained in records relating to a person’s health for purposes of determining eligibility for paratransit service or the transportation disadvantaged program. Effective June 4, 2003.

Ch. 2003-111 (C.S. for S.B. 308)  Enumerates allocation of annual use fees from the sale of Sea Turtle license plates; repeals a provision providing grants for marine turtle research, conservation, and education activities. Effective July 1, 2003.

Ch. 2003-112 (C.S. for C.S. for S.B. 2050)  Creates a presumption of good faith for court-appointed psychologists performing child custody evaluations; provides requirements for legal actions against such psychologists. Effective July 1, 2003.

Ch. 2003-113 (C.S. for S.B. 2248)  Permits state governmental entities to contract with charitable youth organizations for certain public service work; prescribes conditions. Effective June 5, 2003.

Ch. 2003-114 (C.S. for C.S. for S.B. 144)  Creates provisions relating to services for sexual battery victims. Effective July 1, 2003.

Ch. 2003-115 (C.S. for C.S. for S.B. 2172)  Defines the term “dangerous sexual felony offender”; provides for mandatory sentences for such offenders. Effective July 1, 2003.

Ch. 2003-116 (H.B. 747)  Revises time limitations for prosecution of certain sexual battery crimes. Effective October 1, 2003.

Ch. 2003-117 (H.B. 561)  Provides for a cause of action for protective injunctions in cases of sexual violence; permits the victim or the minor victim’s parent or legal guardian to file a petition for such an injunction under certain circumstances. Effective July 1, 2003.

Ch. 2003-118 (C.S. for S.B. 1522)  Creates and revises provisions relating to parental and family involvement in a student’s education. Effective July 1, 2003.

Ch. 2003-119 (C.S. for S.B. 162)  Provides for instruction in American Sign Language in postsecondary institutions and allows foreign language instruction credits for such classes. Effective July 1, 2003.

Ch. 2003-120 (C.S. for C.S. for S.B. 296)  Revises provisions relating to nursing home and continuing care facilities. Effective June 10, 2003.

Ch. 2003-121 (C.S. for C.S. for C.S. for S.B. 310)  Creates a Child Abuse Prevention and Intervention license plate; provides for annual use fee collection and distribution. Effective July 1, 2003.

Ch. 2003-122 (C.S. for S.B. 480)  Creates the Commission on Marriage and Family Support Initiatives; repeals specified provisions relating to the Commission on Responsible Fatherhood and community-based programs to encourage responsible fatherhood. Effective July 1, 2003.

Ch. 2003-123 (S.B. 732)  Abrogates the scheduled repeal of the Miami River Commission. Effective June 10, 2003.

Ch. 2003-124 (C.S. for S.B. 1044)  Provides for electronic mail notice to certain persons requesting notification of any pending water use and impoundment construction permit applications; requires that permits contain specified language. Effective June 10, 2003.

Ch. 2003-125 (C.S. for S.B. 1426)  Permits municipalities or their agencies to adopt per diem and travel expense policies different from state law; provides for default applicability of state law; penalizes false or fraudulent travel claims; permits counties to establish rates exceeding state rates. Effective June 10, 2003, and retroactively operative to January 1, 2003.

Ch. 2003-126 (C.S. for C.S. for S.B. 1434)  Permits certain municipalities to receive specified grants for library establishment, maintenance, and construction; delineates prerequisites; provides for disclosure of certain circulation information to aid in fine collection and overdue book recovery. Effective July 1, 2003.

Ch. 2003-127 (C.S. for S.B. 1442)  Creates and revises provisions relating to child abuse reporting and child protective investigations. Effective June 10, 2003.

Ch. 2003-128 (C.S. for S.B. 2046)  Prohibits a county or circuit court from directing that an imposed sentence be served coterminously with a sentence imposed by another court. Effective October 1, 2003.

Ch. 2003-129 (C.S. for S.B. 2156)  Redesignates the Florida High School Activities Association as the Florida High School Athletic Association; revises provisions relating to the association’s bylaws and board of directors. Effective June 10, 2003.

Ch. 2003-130 (C.S. for S.B. 2366)  Defines the term “maliciously” as used in a specified aggravated child abuse statute. Effective June 10, 2003.

Ch. 2003-256 (H.B. 789)  Creates the Stop Heart Disease license plate; provides for annual use fee collection and distribution.  Effective July 1, 2003.

Ch. 2003-257 (H.B. 1277)  Provides that contracts entered into by unlicensed contractors are unenforceable by such contractors; requires certain swimming pool work to be subcontracted; specifies conditions for performing specialty contracting services without a local professional license and revises contracting licensure requirements for certain business organizations.  Effective June 25, 2003.

Ch. 2003-258 (C.S. for C.S. for S.B. 250)  Expands definitions of the terms “rural hospital” and “infant delivered”; exempts certain rural hospitals from certificate-of-need review requirements for new or replacement construction.  Effective July 1, 2003.

Ch. 2003-259 (S.B. 524)  Revises provisions relating to rules of evidence.  Effective July 1, 2003.

Ch. 2003-260 (C.S. for C.S. for S.B. 958)  Revises provisions relating to public employee retirement.  Effective July 1, 2003, except as otherwise provided.

Ch. 2003-261 (C.S. for C.S. for S.B. 1712)  Revises, transfers, and repeals provisions relating to government; transfers the functions of the Comptroller and Treasurer to the office of the Chief Financial Officer; conforms specified provisions; prescribes powers and duties of the Department of Financial Services, the Financial Services Commission, and the Office of Insurance Regulation.  Effective June 26, 2003.  

Ch. 2003-262 (C.S. for S.B. 1822)  Revises provisions relating to the requirement that the Department of Children and Family Services enter into certain working agreements with local law enforcement agencies and provisions relating to adult protection teams; provides for task force examination of guardianship and incapacity issues; provides that the executive director of the Statewide Public Guardianship Office be appointed by the Secretary of Elderly Affairs.  Effective July 1, 2003.

Ch. 2003-263 (C.S. for C.S. for S.B. 1944)  Creates and revises provisions relating to mobile home owners.  Effective June 26, 2003.

Ch. 2003-264 (S.B. 2002)  Requires law enforcement trainees attending certain training programs to reimburse an employing agency for training expenses, wages, and benefits paid by the agency if the employee terminates employment within a specified time period after graduation; provides a reimbursement schedule and permits civil action to collect such costs.  Effective July 1, 2003.

Ch. 2003-265 (C.S. for S.B. 2260)  Creates , revises, and repeals provisions relating to water management.  Effective June 26, 2003, except as otherwise provided.

Ch. 2003-266 (S.B. 2294)  Includes certificates under a group master policy in an authorization to sell communications equipment property insurance; exempts certain communications equipment property insurance licensees from fingerprint requirements.  Effective June 26, 2003.

Ch. 2003-267 (C.S. for S.B. 2364)  Revises and repeals numerous provisions relating to insurance.  Effective June 26, 2003.

Ch. 2003-268 (C.S. for S.B. 2624)  Revises provisions relating to the Florida Black Business Investment Board, Inc.  Effective July 1, 2003.

Ch. 2003-269 (C.S. for S.B. 2708)  Revises provisions relating to motor vehicle dealers.  Effective June 26, 2003.

Ch. 2003-270 (H.B. 691)  Includes certain financial services facilities as qualified projects for purposes of the capital investment tax credit; expands the definition of target industry business; permits emergency or special circumstance reallocation of specified funds to certain economic development programs and operations.  Effective June 26, 2003.

Ch. 2003-271 (H.B. 1527)  Creates the Florida Alzheimer’s Training Act; requires specified training for persons who care for persons with Alzheimer’s disease and related disorders; provides for approval of training and trainers; encourages certain state educational institutions to provide training about Alzheimer’s disease and related disorders.  Effective July 1, 2003.

Ch. 2003-272 (H.B. 1717)  Revises provisions relating to a public records exemption for information identifying an executioner or any person prescribing, preparing, compounding, dispensing, or administering a lethal injection; repeals a provision creating a public records exemption for information that would identify any person prescribing, preparing, compounding, dispensing, or administering the lethal injection.  Effective June 26, 2003.

Ch. 2003-273 (C.S. for C.S. for S.B. 52)  Requires vision tests for certain driver’s license renewal applicants; prohibits such applicants from renewing electronically or telephonically; requires a study of the effects of aging on driving ability. Effective July 11, 2003, except as otherwise provided.

Ch. 2003-274 (C.S. for S.B. 56)  Provides an exemption from certificate-of-need requirements for certain open heart surgery programs; requires a report about exemption requests; provides for future expiration. Effective July 11, 2003.

Ch. 2003-275 (C.S. for S.B. 726)  Creates the Community Libraries in Caring Program. Effective October 1, 2003.

Ch. 2003-418 (H.B. 35-E)  Permits the governor to issue a one-time stay preventing the withholding of nutrition and hydration in certain circumstances; provides for immunity for persons complying with such a stay; provides for appointment of a guardian ad litem for a person subject to such a stay. Effective October 21, 2003.

Ch. 2003-419 (C.S. for S.B. 8-E)  Exempts certain information, research materials, actual and potential trade secrets, proprietary business information, and meetings held by the Scripps Florida Funding Corporation or the Office of Tourism, Trade and Economic Development from public records and public meetings requirements; provides an exception. Effective November 3, 2003.

Ch. 2003-420 (C.S. for C.S. for S.B. 6-E)  Creates and revises provisions relating to economic development, including creation of the Scripps Florida Funding Corporation. Effective November 3, 2003.

Ch. 2003-421 (H.B. 5-E)  Re-creates the Biomedical Research Trust Fund; carries forward all current balances of the fund; and continues all current sources and uses of the fund. Effective July 1, 2004.

Ch. 2003-422 (C.S. for S.B’s. 14-E and 16-E)  For workers’ compensation purposes, provides that certain construction contracting licensees are not required to obtain approval for change of status or to obtain a specified license or certificate of authority until July 1, 2004; enumerates change of status requirements and procedures; redefines the term “corporate officer.” Effective November 12, 2003.

Ch. 2003-423 (C.S. for S.B. 18-E)  Revises provisions relating to phosphate mining; provides for studies; appropriates funds. Effective November 12, 2003.
